Introduction.

Please read these terms and conditions carefully. If you don’t agree with them do not use this website. Nothing in these terms affects your statutory rights. By using the Chap Clothing website you signify your agreement to be bound by these terms. Please note we reserve the right to change theses terms and conditions at any time without notice. It is your responsibility to check them regularly for any changes.

Permissible Use.

You must be eighteen years old or older to use this site. If you are under eighteen, you may only use this site with the agreement of, and under the supervision of, a parent or guardian. If you do not qualify, please do not use this site.

You may only use the site for your own personal, non-commercial use.

You must not use the Website in any way that; 1, causes or may cause damage to the website or interferes with anyone else’s use or enjoyment of the Website, 2, which is harmful, threatening, harassing, abusive, unlawful, illegal or otherwise objectionable.

Intellectual Property & Copyright

All Content included on the Website, unless uploaded by Users, is the property of Chap Clothing or other relevant third parties. By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights.

Your Shopping Account

You agree that e-mail can be used as a means of communication.

During the registration process, you must choose a username and password. You are responsible for all actions taken under that username and password and must only purchase from Chap Clothing under your own username and password.

We use a third party payment processor to take payment and process any refunds. In the absence of negligence on our part we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us. We do not store payment card details.

You are responsible for ensuring that your account details remain confidential and you agree to accept responsibility for all activities. If you believe this information has become known to someone else or that your account is being misused contact us immediately.

When registering your details ensure that the information you provide us with is complete and correct and that the credit or debit card you are using is your own and that there are sufficient funds in your account to cover payment of the product(s) ordered. You must advise us as soon as possible should this change or you wish your details to be removed.

Chap Clothing reserves the right to alter prices, edit or remove content, refuse access to the website or cancel orders at our discretion. If we cancel an order, it will be without charge to you and you will be notified immediately.

Our Contract

The information we seek from you when placing an order is for billing and delivery purposes or for contacting you if we have a query.

Our clothing is all handmade by a small team and we make many items to order. We reserve the right to not guarantee delivery date on request but we will do everything we can. Please contact us if you need the item by a certain date.

No contract for the sale of any product will exist between you and Chap Clothing until we accept your order by dispatching the product to you. When this happens we will confirm the acceptance by sending you an email. This confirmation email will be sent to the email address given in your order form and will detail products ordered, payment method, cost (including P&P) and usual delivery times.

You must check all the details on this confirmation email are correct and contact us as soon as possible if any details are incorrect.

If your order has not been accepted, you will receive an email from us telling you the reasons why.

Limitation of Liability.

As permissible use of the site is limited personal, non-commercial use, to the maximum extent permitted by law, Chap Clothing accepts no liability for any of the following:

    1. any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities;
    2. loss or corruption of any data, database or software;
    3. any special, indirect or consequential loss or damage.
We have taken strenuous measures to provide accurate images for each product for sale on the site. However, due to a number of different factors such as Internet browsers, monitor colour contrasts etc, we cannot be held responsible or liable for any differences in colour between the image and the actual product.

Definitions.

Chap Clothing, we, us or our means Harry Gibbings, trading as Chap Clothing; and You or your means the person using our site.

Juristiction.

If any court or competent authority finds that any provision of these terms and conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these terms and conditions will not be affected. The Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.
